Terms of Service

SALES, PAYMENT, AND REFUND POLICY

Payment is through Ko-Fi only. All sales are final, commissions cannot be refunded. Prices are non-negotiable.

Split payment can be discussed for returning clients on commissions over $30, but is not guaranteed. First-time clients and commissions $30 or less do not qualify for split payment. If accepted for split payment, 50% or more of payment must be provided upfront. There is a maximum 2 transactions per commission, as every transaction pulls out another fee on my end.

Payment must be received IN FULL before you are sent the final, full-resolution, un-watermarked image.

All major commission details (Character amount, style of commission, etc) are final upon first payment. You can have up to 3 major changes made to the sketch before extra charges of $5 per major edit are made. Major changes may not be accepted at all after the sketch phase. I reserve the right to determine something as a major or minor edit, but a major edit would generally be something that requires me to redo a large part of the commission, e.g. a pose change, swapping large props, etc.


PROCESS

Expect a 1-2 week MINIMUM wait time. It may be shorter or longer than this, but I will keep you updated and send watermarked WIPs throughout the process.

I will contact you through email, Ko-fi, Discord, or Tumblr DMs, whichever is most convenient for you. I strongly encourage at least the final product to be sent through email to ensure no drop in quality.

Commissions are digital only. You cannot and will not receive a physical copy of any of the drawings you commission from me.

I reserve the right to refuse service. I have the right to decline commissions for any reason.

USAGE RIGHTS

My commissions are for personal, non-commercial use only. You may not use my work for profit, including but not limited to using it for products, merch, or as promotion for or as a part of purchasable content. If you would like my art as part of or as promotion for purchasable content, please contact me directly so we can figure it out.

My art cannot be used for AI or for NFTs in any way. If you are found to use AI image generation regardless of relations to my art, your commission will be refused.

I retain the rights to my art. I will post the commission to my socials and may use the commission as an example for future art. If the art is of a character that belongs to you, you will be credited for the character in all usages.

You can use your commission as a profile picture, banner, etc, so long as credit is provided and visible. "Credit to the artist" is not acceptable, you must credit "@bgsartcavern on Tumblr" (and/or Ko-Fi, if you prefer). You may only repost so long as full credit with a link is provided. You may not edit out my signature or social media handle.

My Commission Process

I will contact you throughout the commission process to ensure we are both satisfied with the final product. I can’t continue with the commission if we can’t communicate! Progress shots will be sent along each stage of the commission, and will ensure that things are as they should be before moving on to the next piece.

Progress shots will be watermarked and sent at a lower resolution. The full resolution will be sent to you once the art is finished (and after the full payment comes through if the commission was a split payment).

Visual references are necessary. When working with OCs, Picrews and other character creators are better than nothing at all, so send those if they’re all you have! However, do not use AI image generators. If you do, your commission will be refused.
